What is the ISA?

The Internal Security Act 1960 (ISA) is a preventive detention law in force in Malaysia. Any person may be detained by the police for up to 60 days without trial for an act which allegedly prejudices the security of the country or any part thereof. After 60 days, one may be further detained for a period of two years each, to be approved by theMinister of Home Affairs, thus making indefinite detention without trial. In 1989, the powers of the Minister under the legislation was made immune to judicial review by virtue of amendments to the Act. Now, only the courts are ‘allowed’ to examine and review technical matters pertaining to the ISA arrest.

Since 1960 when the Act was enacted, thousands of people including trade unionists, student leaders, labour activists, political activists, religious groups, academicians, NGO activists have been arrested under the ISA. Many political activists in the past have been detained for more than a decade.

The ISA has been consistently used against people who criticise the government and defend human rights. Known as the ‘white terror’, it has been the most feared and despised, yet convenient tool for the state to suppress opposition and open debate. The Act is an instrument maintained by the ruling government to control public life and civil society.

The ISA goes against the right of a person to defend himself in an open and fair trial. The person can be incarcerated up to 60 days of interrogation without access to lawyers.

The first 60 days

A person detained under the ISA during the first 60 days is held incommunicado, with no access to the outside world. Furthermore, lawyers and family members are not allowed access to the detainee during this initial period. Only after a two-year detention order is signed, the detainee is carted off to the Kamunting Detention Centre to serve his or her two-year term, in which family members are allowed to visit.

Torture

Torture goes concurrently with ISA detention. Former detainees have testified to being subjected to severe physical and psychological torture. This may include one or more of the following: physical assault, forced nudity, sleep deprivation, round-the-clock interrogation, death threats, threats of bodily harm to family members, including threats of rape and bodily harm to their children. Also, detainees are confined in individual and acutely small cells with no light and air, in what is believed to be secret holding cells. These interrogation techniques and acts of torture are designed to humiliate and frighten detainees into revealing their weaknesses and breaking down their defences.

Prolonged torture and deprivation have led to detainees signing state-manufactured ‘confessions’ under severe duress. During the first trial of former Deputy Prime Minister Anwar Ibrahim, police told the courts that the process of ‘extracting confessions’ under duress was called “turning over” and suggested it was a standard practice of the police.

The Legislation

Relevant sections of the legislation are as follows:

Section 73(1) Internal Security Act 1960:
“Any police officer may without warrant arrest and detain pending enquiries any person in respect of whom he has reason to believe-

   1. that there are grounds which would justify his detention under section 8; and
   2. that he has acted or is about to act or is likely to act in any manner prejudicial to the security of Malaysiaor any part thereof or to maintenance of essential services therein or to the economic life thereof.”

Sect 8. Power to order detention or restriction of persons.
“(i) If the Minister is satisfied that the detention of any person is necessary with a view to preventing him from acting in any manner prejudicial to the security of Malaysia or any part thereof or to the maintenance of essential services therein or the economic life thereof, he may make an order (hereinafter referred to as a detention order) directing that that person be detained for any period not exceeding two years.”

Criticism from within

The late Tunku Abdul Rahman, former Prime Minister of Malaysia commenting on the mass arrests of 1987 to a British newspaper, said, “This is becoming more or less a police State … I never dreamt they would resort to those methods of dealing with our citizens. The opposition has the right to talk against the Government, now he (then Prime Minister, Mahathir Mohamad) has arrested all of them.” This aptly sums up the attitude of the government towards popular causes and the opposition.

In Malaya, although the majority of the population came from the Chinese population of two million, there were about 1.5 million Malays and a significant small group that normally fits into a category of “other.”

It should be of no surprise that the Malayan Communist Party was mostly Chinese which grew immensely in numbers after the Chinese revolutionary victory in China in 1949. The key to victory in Malaysia was to separate the Chinese Communist from the neutral Chinese, the Malays and the “others.”

But that is another story.

By the way, the Malayan Chinese Communist were originally supported by the British to fight Japanese occupation. Why is that indigenous forces are always most active to fight an “occupation?”

It took two years of trial and error for the British to get it right in Malaysia. However, in 1950, a retired general was appointed as the High Commissioner’s Director of Operations. General Briggs set up civil/military councils in every state and district on which sat the local police, and the “British military,” under the chairmanship of a senior officer of the “Administration” authorities.

“The time for talk is over, now is the time to act.” With this warning shot, Minister in the Prime Minister’s Department Datuk Seri Nazri Aziz said the government would be taking legal action against bloggers who flagrantly belittled Islam or the Yang di-Pertuan Agong.

He told the Dewan Negara yesterday that three laws could be used against the bloggers: The Internal Security Act (ISA), Sedition Act and Section 121b of the Penal Code.

Section 121b deals with offences against the authority of the king, ruler or Yang DiPertua Negeri and carries a maximum penalty of life in prison.

Speaking at the Malaysian Press Institute Press Awards Night here yesterday, Deputy Prime Minister Datuk Seri Najib Razak said the government was deeply troubled by the growth of “irresponsible” alternative media.

“In the name of freedom, these websites allow the broadcast of slander, lies and swearing, the use of harsh, degrading language and racial slurs without regard for the reader or those concerned,” he said.

“Even though the government has been tolerant of anti-government positions and criticisms on the Internet, we are very concerned about statements that insult religion and reek of racism.”

Najib said webmasters and web journalists were not exempted from the laws of the country and the government was duty-bound to protect the peace.

“We will not permit any party to disturb the nation’s harmony and cause unease among the community,” he said.

Nazri said the government was looking at formulating new laws allowing it to monitor and act against offending bloggers.

“This is in areas not provided for by the ISA, Sedition Act or Section 121b of the Penal Code,” he said.

He said the proposed legislation was not intended to strangle the freedom of the Internet.

“This is to put a stop to the freedom to lie in the blogosphere.

“We want blogs to be clean, a place to obtain accurate information, a reference point for honest opinion, not a platform to abuse and slander people,” he said.

Nazri told senators the government had lost its patience with bloggers who broke the law and it could not be “seen as impotent or weak” in the face of their defiance.

He said bloggers had come to believe they were like members of parliament, who enjoyed immunity to say what they wanted under the law.

“But the reality is that, despite the immunity, MPs and senators have to play by some basic rules.

“This is not the case with bloggers who flout the law. It is time to act, we have been very patient,” he told cheering senators while replying to points raised during the debate on the Electronic Government Activities Bill 2007.

Senators used the opportunity to criticise bloggers against the backdrop of a police report lodged on Monday at the Dang Wangi police station by Umno information chief Tan Sri Muhammad Muhammad Taib against the Malaysia Today website for insulting the king and Islam.

Nazri told senators that writings describing Islam as “a big lie fabricated by Arabs who had put a huge rock (the Kaabah) in the middle of the desert were not only ill-mannered but could provoke anger among Muslims”.

He said the hatred perpetuated by bloggers was spread further by those who read them.

Firstly, I am not his fan but, i agree with his point of view.

to the malay: not every chinese are rich. there are many poor peoples among Chinese and Indian, why they can’t get any assistance from government? Even though some Chinese that having a heavy burden (which have more children), they can’t get text-book loan after their first or second child. The reason is their first and second child already entitled for the text-book-loan? Do you think this is funny? Maybe this is not happen in Malays, so you don’t know. Most Chinese paying for high income taxes, and hope that government using this money to develop country, develop infrastructure, helping poor but not helping those already rich enough. we can help poor malaysian, but why we want to give the money for those rich ” malay-sian “! They’re no asking for more, they just asking for fair. you need to believe “Malay Boleh!”. you should show that you don’t need “crutch”.

Is there a way for Malaysians to live harmoniously? I do believe there is, but it would require a change of attitudes of every Malaysian. A country can be like a family, and the government as the parents. So all the citizens are their children. No matter whether you are Chinese or Malay or Indian, we are all brothers and sisters. Also I think the quota policy and the privilege policy should be abolished, because those policies destroy the potential goodwill and friendships between the different races. Every Malaysian must begin to believe in the “Malaysian Dream,” not just “Malaysia Boleh!” . All must believe and strive for a day when hard work by each individual will be rewarded and when equal opportunity will be the goal for Malaysian humanity. I hope that, Malaysians, will have freedom and human equality, just like the freedom and equality enjoyed in many countries.
